The Company may terminate or suspend access to the Application immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Application will cease immediately.
To the fullest extent permitted by applicable law, in no event shall the Company, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from:
The Application is provided on an "AS IS" and "AS AVAILABLE" basis. The Company makes no representations or warranties of any kind, express or implied, regarding the operation of the Application or the information, content, materials, or products included in the Application. You expressly agree that your use of the Application is at your sole risk.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms or the Application shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the United States, and the language of the arbitration shall be English.
If you are a consumer residing in the European Union, you have the right to withdraw from these Terms within 14 days without giving any reason. To exercise your right of withdrawal, you must inform us of your decision by a clear statement (e.g., a letter sent by post or email).
You represent and warrant that (i) you are not located in a country that is subject to a U.S. government embargo, or that has been designated by the U.S. government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. government list of prohibited or restricted parties.
If any provision of these Terms is found to be invalid or unenforceable by a court, the remaining provisions of these Terms shall remain in effect. The failure of the Company to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
These Terms may be translated into other languages. In the event of any conflict between the English version and any translated version, the English version shall prevail.
The Company reserves the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
